Terms and Conditions

ARTICLE 1 – ACCEPTANCE OF THESE TERMS AND CONDITIONS:

These General Terms and Conditions of Sale (GTC) govern all sales made by DELTA EVASION and its consortium

Consequently, placing an order implies the customer’s full and unconditional acceptance of these Terms and Conditions, to the exclusion of any other documents, such as brochures or catalogs issued by DELTA EVASION, which are for informational purposes only.

ARTICLE 2 – THE RESERVATION:

To book a tandem flight, customers must reserve a date in advance: by phone at 00 33 6 08 32 49 59 or 00 33 6 07 07 10 75, or in person at one of our three sales locations (Annecy Folie – L’Atterrissage de Doussard – L’Edelweiss Restaurant Stand at Col de la Forclaz) or on our website:www.deltaevasion.com.

Registration requires:

– Tohave no medical contraindicationsto participating in our activities. The participant agrees to disclose any health information that could affect the chosen activity (no medical certificate is required).

– Be able to run during takeoff (for paragliding and hang gliding); if this is not the case, the participant agrees to indicate this at the time of registration.

– Provide accurate information regarding the participants’ physical characteristics (weight, height, age). If any of this information is not provided correctly, you may lose your reservation without financial compensation on the day of the flight.

ARTICLE 3 – PURCHASE OF GIFT CERTIFICATES:

Under the Consumer Code, customers have a 7-day right of withdrawal from the date of purchase of an online or physical gift card. If the request for withdrawal is made within 7 days, the amount will be refunded. No refunds will be issued after the 7-day withdrawal period has expired. Gift cards are valid for 24 months from the date of purchase.

ARTICLE 4 – PROVISION OF SERVICES:

To enable Delta Evasion to provide its services under the best possible conditions, the customer agrees to arrive at the time specified at the time of booking.

To ensure that activities run smoothly and out of respect for the other participants and your instructor, please review the itineraries and other instructions we have provided in advance. Please plan your travel time carefully to ensure you arrive on time. We do not tolerate any delays. Instructors must depart for activities, and no refunds or compensation will be provided.

No customer may perform the service without having followed all safety guidelines and instructions; therefore, in the event of an irreparable delay, the service will not be provided.

ARTICLE 5 – CANCELLATION – CHANGES BY THE CUSTOMER – DELAY BY THE CUSTOMER:

If, after a reservation has been made, the customer wishes to cancel or change the number of participants and/or the date, they must comply with the following conditions:

For reservations of 6 people or fewer:

• Cancellations or changes can be made free of charge up to 48 hours before the scheduled service. If the request is made less than 48 hours before the service, DELTA EVASION will charge the full amount for the service.

For groups of 7 to 10 participants:

• If the request is made more than 8 days before the scheduled date, no penalties will be imposed. The contract will be amended accordingly.
• If the request is made within 7 days of the service or if the request for a change is not made in advance, DELTA EVASION will bill the full amount of the original service.
• For groups of more than 11 people:
• If the request is made more than 15 days before the scheduled date, no penalties will be imposed. The contract will be amended accordingly.
• If the request is made within 14 days of the service or if the request for a change is not made in advance, DELTA EVASION will bill the full amount of the original service.

In the event of force majeure and upon presentation of a medical certificate dated no later than the day of the booked service, DELTA EVASION may refund the amount paid, but the customer may not demand such a refund. In any case, the customer agrees to notify the company of any changes regarding the reservation, including changes to the itinerary, changes in the number of participants, delays, or cancellations.

Given this information, no changes will be accepted once the service has begun, whether they concern the main services or the ancillary services booked by DELTA EVASION through third-party providers.

Furthermore, in the event of a complete cancellation of an order or reservation by the customer, DELTA EVASION will retain any amounts already paid as compensation.

No delays will be tolerated in order to ensure that activities run smoothly:

The customer therefore agrees to arrive on time.Any delay will result in the service being billed. 

ARTICLE 6 – CANCELLATION OR MODIFICATION BY DELTA EVASION:

DELTA EVASION cannot be held liable for any delays in service caused by circumstances beyond its control, such as changes in regulations, force majeure, strikes, traffic accidents, or the suspension of air travel…

Weather conditions are not grounds for postponing the activity: only the instructors are authorized to decide whether or not to cancel the activity based on current weather conditions (rain, unfavorable wind direction, thunderstorms, etc.).

Depending on the weather conditions on the day, instructors may exclude certain participants based on their physical condition.

In such cases, DELTA EVASION and the CUSTOMER will mutually agree on an alternative date or a full cancellation. In the event of cancellation, the deposit will be automatically refunded.

Instructors reserve the right to adjust the outing based on the participants' skill level.

ARTICLE 7 – EXCLUSION:

Instructors reserve the right to exclude any participant who is intoxicated or whose behavior is likely to disrupt the smooth running of the activity or jeopardize the safety of the group. In such cases, the customer or participant will not be entitled to any refund or compensation.

ARTICLE 8 – INSURANCE:

Instructors are covered by professional aviation liability insurance for each of the clients in their care.

The company shall not be held liable for any damage caused by users' misconduct.

Outdoor activities take place in a specific environment known as a "high-risk" environment.

Each participant is aware that, given the specific nature of the activities involved, they may be exposed to certain risks, particularly due to remoteness, isolation, and the specific nature of the activity and the environment. They accept these risks with full knowledge of the facts and must exercise due caution and follow the recommendations of the relevant authorities.

ART. 9 – Loss or Damage:

No compensation may be claimed for any loss or damage to property during the services.

Participants may bring a cell phone or other device with them, provided they are wearing clothing with a zippered pocket. However, in the event of negligence on their part, no compensation may be claimed.
